Important Note

Strict time limits apply to Employment Tribunal claims and appeals against Employment Tribunal decisions.

Employment Tribunal (ET) Claims - A Claimant has 3 months less 1 day to send a dismissal claim in the employment tribunal. If you were dismissed on 20 April 2009, the tribunal must therefore receive your claim on or by 19 July 2009 - otherwise the claim will be out of time and you may lose the right to continue with your case. Please note there are special rules affecting constructive dismissals.

If your claim is not about a dismissal you must generally send a written complaint to your employer and wait 28 days before you complain to the tribunal. You must do this within 3 months of treatment you are complaining about. Time limits are extended in these circumstances. However, the time limit rules are very complicated and shortly, they are due to be changed. As different rules will apply depending on whether you are an employee or another type of worker we strongly advise that you seek specialist legal advice about the relevant time limits and grievance rules that will apply to you.

Employment Tribunal Appeals - You only have 42 days (6 weeks) from the date of the ET decision to appeal that decision to the Employment Appeals Tribunal. If your ET decision was sent to you on Monday 20 April 2009, the EAT must receive your appeal by 4pm on Monday 1 June 2009.
