Important Note

Strict time limits apply to Employment Tribunal claims and appeals against Employment Tribunal decisions.

Employment Tribunal (ET) Claims - The Respondent has 28 days to file a defence from the date on which it is sent the claim by the ET. Time-limit extensions to file the defence may be granted so long as an application is made to the ET within the 28 day time-limit.

Employment Tribunal Appeals - You only have 42 days (6 weeks) from the date of the ET decision to appeal that decision to the Employment Appeals Tribunal. If your ET decision was sent to you on Monday 20 April 2009, the EAT must receive your appeal by 4pm on Monday 1 June 2009.

WARNING – the preparation of a claim or defence (or EAT appeal) requires expert legal advice. With such advice at an early stage, you greatly increase your chance of winning your claim or defending the claim made. It is also much more cost-effective to take early advice than to approach a lawyer further on in the proceedings, when many legal points may already be lost.
